Runtiva, Inc., and as applicable, its subsidiaries and affiliates ("Runtiva," "we," "our," or "us") own and operate the Runtiva fantasy sports website located at www.runtiva.com and its related mobile app, through which we offer free-to-play games, contests, tools, and fantasy sports-related products and services (collectively, the "Services"). This Privacy Policy describes how we collect and process your personal information through the Services. By using the Services, you are consenting to the practices described in this Privacy Policy.

This Privacy Policy should be read in conjunction with our Terms of Use. This Privacy Policy and the Terms of Use, together with any additional terms, addenda, or documents that may be referenced herein, form an agreement between you and us in connection with the Services.

Please read our U.S. State Privacy Notice for additional information about the processing of your personal data and your rights under applicable U.S. state data privacy laws.

Information We Collect

We collect various types of personal information to provide, improve, and secure our fantasy sports app and related services (collectively, the "Services"). This information is collected from different sources and for the purposes described in the "How We Use and Share Information" section of this Privacy Policy. Below, we describe the categories of information we collect, organized by the primary sources. We only collect information that is necessary for our operations and comply with applicable data protection laws, such as providing notice of collection and obtaining consent where required.

By using our Services and submitting information to us through your use of our Services, we collect several types of information from and about users to provide and continually improve our products and services. This information is provided to us either directly by you or through your use of our Services. You can choose not to provide certain information, but then you might not be able to take advantage of many of our Services.

Information You Give Us:

When you create an account, participate in contests, interact with features, or otherwise use our Services, you may provide us with the following categories of personal information:

Personal information, including your name, mobile phone number, email address, date of birth, and/or passwords you create.
Profile information, including your location, profile photo, username, preferences, and/or avatar.
Identification and verification information, required for certain aspects of the Services (such as age or identity verification for compliance reasons; providing this information, when requested, is a mandatory condition of using our Services). This may include copies and information from identification documents (such as your driver's license or passport), tax-related information, permanent and temporary address, and any other information needed to verify your identity and/or comply with applicable laws and regulations, as well as other sensitive personal information such as your social security number.
Services engagement information, including discussion topics you create or comment on, league information, information we collect when you connect our Services to third-party platforms, websites, and/or social network services or use other social or player-to-player functionality, and/or information collected when you invite your friends to use the Services.
Photo, chat, and messages information, including photos, animated images, and direct or private messages sent to other users, as well as group messages sent to members of a particular group or league.
Commercial information, including records of products or services purchased or obtained, as well as other purchasing or consuming histories. By way of example only: (a) if you use our contests, we collect information about the entry fees you have paid, prize history, and/or withdrawal information; and (b) where applicable, we collect information about your purchase of virtual currencies and virtual items within relevant portions of the Services.
Address book / contact information, in accordance with your device permissions.
Correspondence you send to us and other information, including information that you provide us with when you fill in forms or answer questions or surveys when using any of our Services, contact us through our customer service channels, respond to messages and communications that we send you, and/or interact with us on our social media channels.

Device error information, including information about the error, the time the error occurred, the feature being used, the state of the application when the error occurred, and/or any communications or content provided at the time the error occurred.
Any other information you provide to us directly or indirectly through using or otherwise accessing the Services.

Automatic Information:

We may automatically collect the following categories of internet, electronic activity, and other information from the devices and browsers you use to access our Services. This helps us understand usage patterns, enhance security, and improve functionality:

Device and hardware information, including your device type, operating system and platform, and the technology on the devices you use to access the Services.
Network and connection information, including your internet protocol (IP) address and internet service provider.
Identifiers, including device and advertising identifiers, probabilistic identifiers, and other unique personal and/or online identifiers.
Browser and language information, including browser type and version, browser plug-in types and versions, and default device language.
Usage and interaction information, including application usage information, date and time of your visit, information about the links you click, pages you view, and advertising you interact with within the Services and other information about how you use and interact with the Services (by way of example only, this could include details about how and when you play our games or visit our website), pages that you visit before and after using the Services, browsing history, search history, and standard server log information.
Location and time information, including time zone setting and location (including precise geolocation data for purposes such as verifying your location, processing payments, performing analytics, delivering relevant content and ads, sharing with vendors for location-based services, and legal/regulatory compliance; we also collect non-precise geolocation data, such as city and state based on IP address, to customize experiences and serve relevant ads).
Inferred information, including inferences used to create a profile about preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
Invite and referral link information. When you open a Runtiva invite or referral link, we record the visit, including the link you opened, the time, your IP address, and your browser or device type. If you choose to enter your mobile number on an invite page to save your invite, we store a secured (hashed) version of that number, together with the invite details and the IP address of the request, so we can recognize the invite when you create an account with that number. We do not store the number itself.

Information from Other Sources:

We may acquire details about you from outside entities to better our Services, confirm user identities, and meet regulatory standards. This encompasses:

Data from partners and aggregators, such as details obtained from related entities or external businesses (for example, content publishers, service platforms, ad networks and collaborators, or information compilers). This could cover characteristics related to you and your hobbies, along with data on other applications you engage with, population statistics, and exact or approximate positional details.
Compliance-related verification data, gathered to adhere to relevant legal and sector standards (like confirming age and authenticity). This may involve, among other things, your full name, birth date, residential address, telephone number, government-issued identification number, and additional identifying details. We might obtain and authenticate this data ourselves or via specialized external vendors who safely retrieve information from sources like communication providers, financial reporting agencies, and similar verification entities to validate your identity. During this procedure, these vendors could gather or validate details linked to your phone number for risk evaluation purposes. You might need to verify or adjust automatically populated information during registration. These external vendors are obligated by agreement to handle your data solely for delivering verification support to us and in line with pertinent privacy regulations.

Information collected from the referenced external parties may further be governed by their individual privacy policies and applicable guidelines.

How We Use and Share Information

We use the personal data we collect for a variety of purposes related to operating our fantasy sports app, providing our services, and managing our business. These purposes are grounded in one or more legal bases under applicable data protection laws or similar regulations. Below, we outline the key purposes for which we process your personal data, grouped by the primary legal bases that justify such processing. We only process personal data where it is necessary and proportionate to achieve these purposes.

Processing to Perform Our Contract with You

Some of our processing of personal data is necessary to meet our contractual obligations with our players. For example:

Administering and providing our products and services, such as creating and managing your account, facilitating participation in fantasy sports contests, processing entries and prizes, and enabling features like team selection, scoring, and leaderboards.
Providing customer service, including responding to your inquiries, resolving disputes related to contests or account issues, and ensuring smooth user experience within the app.

Without this processing, we would not be able to deliver the services you have agreed to under our terms of use or any specific contest rules.

Processing Based on Our Legitimate Interests

We process personal data for our legitimate interests (or those of a third party) where these interests are not overridden by your rights and freedoms. We conduct balancing assessments to ensure this processing is fair and transparent. Our legitimate interests include running an efficient, secure, and innovative fantasy sports platform. Specific purposes include:

Marketing our services, such as sending you promotional communications about new contests, features, or partnerships that may interest you based on your app usage (you can opt out of marketing at any time via your account settings).
Protecting our players, personnel, and property, including implementing security measures to safeguard user accounts, prevent unauthorized access, and maintain the integrity of our platform.
Analyzing and improving our business, such as aggregating usage data to understand player trends, optimizing app performance, and developing new features or enhancements.
Improving our services, including conducting research on user behavior to refine gameplay mechanics, user interfaces, and overall app functionality.
Crediting referrals, such as using invite and referral link information to work out who referred you, apply offers you are eligible for, and calculate rewards for the person or partner who referred you.
Processing job applications, such as reviewing resumes and contact details submitted through our career portal to evaluate candidates for employment opportunities.
Protecting or exercising our legal rights, including defending against legal claims; by way of example only, this includes use of your information to detect, prevent, and investigate fraud and other illegal activity and violations of this Policy and/or other guidelines/rules (e.g., monitoring for cheating in contests or suspicious account activity).
Managing legal issues, such as processing personal data for the legitimate interests of our affiliates or business partners, including to offer special events or contests or assisting with marketing collaborations that enhance the player experience.

We may also process data for other legitimate interests that arise in the course of business, always ensuring they align with your reasonable expectations.

Processing Based on Consent

Where required by law, and in some other cases, we handle personal data on the basis of your implied or express consent. For instance:

We may seek your consent to use location data for personalized contest recommendations or to share your data with third-party partners for targeted advertising.
You can withdraw your consent at any time by updating your preferences in the app or contacting us, though this may limit certain features.

We will always make it clear when consent is the basis for processing and provide easy ways to manage it.

Processing for Legal Compliance

We need to use and disclose personal data in certain ways to comply with our legal obligations. This includes:

Complying with applicable laws and regulations, such as tax reporting requirements, anti-money laundering rules, or responding to requests from regulatory authorities overseeing gaming or data protection.
Retaining records as required by law, for example, to verify age eligibility for participation in paid contests or to audit financial transactions.

In all cases, we limit processing to what is necessary for compliance and take steps to protect your data during such disclosures.

We may disclose or share your personal information with third parties under certain circumstances as described below. We do not sell your personal information for monetary compensation, but certain disclosures (such as for targeted advertising) may be considered a "sale" or "sharing" under applicable U.S. state privacy laws. For more details on these practices and your opt-out rights, please refer to our U.S. State Privacy Notice.

Categories of Recipients

We may share your personal information with the following categories of third parties for the purposes outlined in this Privacy Policy:

Service Providers and Vendors: We engage third-party companies to perform services on our behalf, such as payment processing (e.g., for deposits and withdrawals), identity verification, fraud detection, analytics, hosting, customer support, and marketing services. These providers access only the information necessary to fulfill their functions and are contractually obligated to protect it and use it solely for the services they provide to us.
Affiliates and Business Partners: We may share information with our affiliated companies or partners involved in operating our fantasy sports platform, such as co-branded contests or promotions. This helps us deliver integrated services and features.
Advertising and Analytics Partners: As detailed in our Advertising, Cookies, and Similar Technologies section below, we work with third-party advertising networks, social media platforms, and analytics providers (e.g., Google Analytics) to deliver personalized ads, measure campaign effectiveness, and analyze user trends. This may involve sharing identifiers like IP addresses, device IDs, or hashed emails for interest-based advertising.
Referring Ambassadors and Partners: If you joined through an ambassador's or partner's invite or referral link, we may tell them that someone they referred created an account, and share the limited activity needed to calculate their rewards (for example, whether a qualifying deposit or contest entry took place). We do not share your phone number with them.
Government Entities and Law Enforcement: We may disclose information if required by law, such as in response to subpoenas, court orders, or regulatory requests. We also share data to comply with legal obligations, enforce our terms, prevent fraud, or protect the safety of users and the public.
Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or similar corporate event, your personal information may be transferred as a business asset to the acquiring entity, subject to applicable laws.
With Your Consent: We may share your information for other purposes with your explicit consent, such as sharing contest results publicly if you opt in or integrating with third-party services (e.g., social media logins).

Safeguards for Sharing

We require all third parties with whom we share personal information to implement appropriate security measures and limit their use of the data to the specified purposes. We do not authorize them to use or disclose your information except as necessary to perform services for us or comply with legal requirements.

We do not knowingly collect or share personal information from children under 13 without verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA). Our platform is not directed to children under 13.

For residents of Applicable States (as defined in our U.S. State Privacy Notice), additional details on disclosures, including categories of personal information shared and for what purposes, are provided in that Notice.

SMS Communications

Runtiva offers SMS (text message) notifications as an opt-in service. The following terms govern our SMS communications.

Categories of Messages

SMS messages from Runtiva may include: deposit and withdrawal confirmations, contest entry confirmations, lineup-lock reminders, match-start alerts, results notifications, responsible-gaming notifications (such as deposit-limit warnings and account-security alerts), and marketing messages (new contest announcements, special-event promotions, and re-engagement offers).

Message Frequency

Recipients may receive 1–3 messages per week (capped at one message per day per user). Message frequency may vary based on the categories of messages a user has opted into and the user's activity on the platform.

Message and Data Rates

Message and data rates may apply, based on the recipient's mobile carrier plan. Runtiva does not charge for SMS messages; standard carrier message and data rates apply to the recipient.

Mobile Number Non-Sharing

Runtiva does not share, sell, rent, or lease mobile phone numbers collected for SMS communications with third parties for marketing or promotional purposes. Mobile phone numbers are shared only with our SMS service provider (Twilio Inc.) for the sole purpose of delivering the SMS messages users have consented to receive, and as otherwise required by law.

Opt-In

Users opt in to receive SMS communications during account registration in the Runtiva mobile app (iOS or Android) by checking a dedicated SMS-consent checkbox, separate from Terms of Service acceptance. Opt-in is also available at any time after registration via Account > Notification Preferences in the mobile app.

Opt-Out and Help

Users may opt out of SMS communications at any time by replying STOP to any message received from Runtiva. Confirmation of opt-out will be sent. Users may also change their SMS preferences in the mobile app preference center, and may re-subscribe by replying START. For help with SMS communications, reply HELP to any message or contact support at support@runtiva.com.

Compliance

Runtiva's SMS program is designed to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and the Cellular Telecommunications Industry Association (CTIA) Short Code Monitoring Handbook. Recipients who believe they are receiving SMS communications in error may contact Runtiva support immediately.

Advertising, Cookies, and Similar Technologies

We and our third-party partners use cookies, web beacons (also known as pixels or clear GIFs), local storage, device identifiers, and other similar tracking technologies (collectively, "Tracking Technologies") on our website, mobile apps, and other services (collectively, "Services") to enhance your experience, analyze usage, personalize content, and deliver targeted advertising. This section explains how we use these technologies, the types involved, their purposes, and your choices for managing them.

Types of Tracking Technologies We Use

Cookies: Small text files stored on your device that help us remember your preferences, login details, and interactions with our Services.
Web Beacons/Pixels: Tiny graphics embedded in web pages, emails, or ads that allow us to track when content is viewed or interacted with.
Local Storage and Similar: Technologies like HTML5 local storage that store data on your device for similar purposes as cookies but may persist longer.
Device Identifiers: Unique IDs from your mobile device (e.g., Apple IDFA or Google Advertising ID) used for personalized features and ads.
Other Technologies: Log files, SDKs (software development kits), and scripts that collect data automatically.

These technologies may be session-based (temporary and deleted when you close your browser) or persistent (remain until deleted or expired).

Purposes for Using Tracking Technologies

We use Tracking Technologies for the following purposes:

Essential/Functionality: To operate our Services, such as maintaining your session, enabling secure logins, and remembering your account settings or contest preferences.
Performance/Analytics: To understand how users interact with our Services, track site traffic, measure feature usage (e.g., contest entries or app navigation), and improve performance. We may use tools like Google Analytics for this.
Personalization: To customize your experience, such as recommending fantasy contests, sports events, or promotions based on your past activity and interests.
Advertising: To deliver relevant ads on our Services and across other websites or apps. This includes interest-based or targeted advertising, where ads are tailored to your inferred interests (e.g., based on sports preferences or browsing history). We may also measure ad effectiveness and limit ad frequency.
Security and Fraud Prevention: To detect and prevent unauthorized access, fraud, or abuse.

Third-Party Tracking and Advertising

We partner with third-party advertising networks, analytics providers, and social media platforms (e.g., Google, Facebook) that may place their own Tracking Technologies on our Services. These third parties collect information about your online activities over time and across different websites or apps to provide targeted ads, analytics, and other services.

For example:

Advertising partners may use your device identifiers or hashed email addresses to serve ads related to fantasy sports or betting on other platforms.
Analytics providers help us generate reports on user trends without identifying individuals.

We do not control these third parties' practices, and their use of your data is subject to their own privacy policies.

Your Choices and Opt-Out Options

You have options to manage Tracking Technologies and advertising preferences:

Browser Settings: Most browsers allow you to block or delete cookies. You can set your browser to notify you when a cookie is sent or refuse all cookies. Note that disabling cookies may limit some features of our Services, such as personalized recommendations.
Mobile Device Settings: On iOS or Android devices, you can limit ad tracking via your device settings (e.g., "Limit Ad Tracking" on iOS or "Opt out of Ads Personalization" on Android).
Opt-Out Tools for Targeted Advertising:
- Visit the Digital Advertising Alliance (DAA) at https://optout.aboutads.info or the Network Advertising Initiative (NAI) at https://optout.networkadvertising.org to opt out of interest-based ads from participating companies.
- For Google-specific opt-outs, visit https://adssettings.google.com.
- Download the DAA's AppChoices app at https://youradchoices.com/appchoices for mobile opt-outs.
Do Not Sell or Share My Personal Information: As described in our U.S. State Privacy Notice, residents of certain states can opt out of the sale or sharing of personal information for targeted advertising. Submit a request via our privacy portal at https://runtiva.com/privacy-policy or email privacy@runtiva.com.
Global Privacy Controls (GPC): We honor browser signals like GPC where required by law, which automatically opts you out of sales/sharing for targeted ads.

Opt-outs are specific to your browser or device, so you may need to opt out on each one you use. Clearing cookies may reset your choices. We do not respond to general "Do Not Track" signals from browsers, as there is no industry standard for compliance.

What Information Can I Access?

You can access your information, including your name, address, payment options, profile information, and purchase history in the "Your Account" section of the website or app.

Minors

Our Services are not designed for minors, as defined under applicable laws for handling personal information. We do not intentionally gather or store personal data from minors through our platform.

Should we learn that a minor has provided personal information, we will immediately delete that data from our systems and terminate the associated account.

If you are a parent or guardian and suspect your child under 18 has shared personal information with us, please contact our Privacy Team at privacy@runtiva.com, and we will take steps to remove the child's data promptly.

Data Retention, Information Security, and Integrity

We are committed to handling your personal data responsibly, which includes retaining it only as long as necessary, implementing robust security measures to protect it, and ensuring its accuracy and integrity. This section explains our practices in these areas.

Data Retention

We retain your personal data for as long as it is reasonably necessary to fulfill the purposes for which it was collected, and in accordance with applicable law. The specific retention periods vary depending on the type of data and the context in which it is used. For example:

Account and profile information may be retained for the duration of your active use of our Services, plus a reasonable period thereafter to handle any post-account closure inquiries or disputes (typically up to 2 years after account deactivation).
Transactional and commercial data, such as contest entries, payment records, and prize histories, are kept for at least 7 years to comply with tax, accounting, and legal requirements.
Usage and analytics data may be retained in aggregated or anonymized form indefinitely to improve our Services, but identifiable data is deleted after 24 months unless needed for ongoing purposes.
Verification and compliance-related data, including identification documents, is retained for the minimum period required by applicable laws (e.g., anti-money laundering regulations) or until the relevant legal obligations are met.
Mobile numbers saved on an invite page are kept only in hashed form, and only until an account is created with that number or for up to 30 days, whichever comes first; after that they are no longer used and are deleted. Records of visits to invite and referral links are kept for up to 90 days.

We may also retain data longer if required for legal compliance, to resolve disputes, enforce our agreements, or protect our rights, such as in the event of litigation or regulatory investigations. Once personal data is no longer needed, we securely delete or anonymize it in accordance with industry standards. If you request deletion of your data (subject to any legal retention requirements), we will process such requests promptly as described in the "Your Rights and Choices" section (if applicable in your jurisdiction).

Information Security

Protecting your personal data is a top priority. We implement reasonable administrative, technical, and physical safeguards to help protect your information from unauthorized access, use, alteration, disclosure, or destruction. These measures include:

Encryption: We use encryption technologies (such as TLS/SSL) for data in transit and at rest where appropriate, particularly for sensitive information like payment details and identification data.
Access Controls: Access to personal data is restricted to authorized personnel and third-party service providers who need it to perform their functions, and we require them to adhere to strict confidentiality obligations.
Security Monitoring: We employ tools to detect and respond to security threats, including regular vulnerability assessments, intrusion detection systems, and monitoring for suspicious activity (e.g., to prevent fraud in contests).
Incident Response: In the event of a data security incident, we have protocols in place to investigate, mitigate, and notify affected individuals and authorities as required by law.

While we strive to use commercially acceptable means to protect your data, no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security, and you use our Services at your own risk. We encourage you to use strong, unique passwords and report any suspected security issues to us immediately.

Data Integrity

We take steps to ensure that the personal data we collect and maintain is accurate, complete, and up-to-date for the purposes for which it is used. This includes:

Relying on you to provide accurate information during registration, verification, and interactions with our Services.
Allowing you to review and update your personal information through your account settings, such as editing your profile, contact details, or preferences.
Periodically verifying data where necessary, such as re-confirming identity for high-value transactions or contests.

If you believe any of your data is inaccurate or incomplete, you can contact us to request corrections. We will respond to such requests in a timely manner, subject to verification of your identity and any applicable legal requirements. Maintaining data integrity helps us provide better Services and ensures compliance with data protection laws.

Changes and Updates

If you choose to use our Services, your use and any dispute over privacy is subject to this Privacy Policy and our Terms of Use, including limitations on damages, resolution of disputes, and application of the law of the state of Texas.

We may modify this Policy from time to time, in our sole discretion. When any such updates are made, we shall revise the "Last updated" date above and post the new version. We recommend that you review this Privacy Policy each time you visit and/or use the Services in order to stay informed of our ongoing practices. If a revision to this Privacy Policy, in our sole discretion, is material, we will notify you by contacting you through the email address associated with your account. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
