Runtiva, Inc., and as applicable, its subsidiaries and affiliates ("Runtiva," "we," "our," or "us") own and operate the Runtiva fantasy sports website located at www.runtiva.com and its related mobile app, through which we offer free-to-play games, contests, tools, and fantasy sports-related products and services (collectively, the "Services"). This Privacy Policy describes how we collect and process your personal information through the Services. By using the Services, you are consenting to the practices described in this Privacy Policy.

This Privacy Policy should be read in conjunction with our Terms of Use. This Privacy Policy and the Terms of Use, together with any additional terms, addenda, or documents that may be referenced herein, form an agreement between you and us in connection with the Services.

Information We Collect

We collect various types of personal information to provide, improve, and secure our fantasy sports app and related services (collectively, the "Services"). This information is collected from different sources and for the purposes described in the "How We Use and Share Information" section of this Privacy Policy. Below, we describe the categories of information we collect, organized by the primary sources. We only collect information that is necessary for our operations and comply with applicable data protection laws, such as providing notice of collection and obtaining consent where required.

By using our Services and submitting information to us through your use of our Services, we collect several types of information from and about users to provide and continually improve our products and services. You can choose not to provide certain information, but then you might not be able to take advantage of many of our Services.

By way of example only: (a) if you use our contests, we collect information about the entry fees you have paid, prize history, and/or withdrawal information; and (b) where applicable, we collect information about your purchase of virtual currencies and virtual items within relevant portions of the Services.
Address book / contact information, in accordance with your device permissions.
Correspondence you send to us and other information, including information that you provide us with when you fill in forms or answer questions or surveys when using any of our Services, contact us through our customer service channels, respond to messages and communications that we send you, and/or interact with us on our social media channels.

We might obtain and authenticate this data ourselves or via specialized external vendors who safely retrieve information from sources like communication providers, financial reporting agencies, and similar verification entities to validate your identity. During this procedure, these vendors could gather or validate details linked to your phone number for risk evaluation purposes. You might need to verify or adjust automatically populated information during registration. These external vendors are obligated by agreement to handle your data solely for delivering verification support to us and in line with pertinent privacy regulations.

Information collected from the referenced external parties may further be governed by their individual privacy policies and applicable guidelines.

How We Use and Share Information

We use the personal data we collect for a variety of purposes related to operating our fantasy sports app, providing our services, and managing our business. These purposes are grounded in one or more legal bases under applicable data protection laws or similar regulations. Without this processing, we would not be able to deliver the services you have agreed to under our terms of use or any specific contest rules.

We do not authorize them to use or disclose your information except as necessary to perform services for us or comply with legal requirements.

We do not knowingly collect or share personal information from children under 13 without verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA). Our platform is not directed to children under 13.

SMS Communications

Runtiva offers SMS (text message) notifications as an opt-in service. The following terms govern our SMS communications.

Categories of Messages

SMS messages from Runtiva may include: deposit and withdrawal confirmations, contest entry confirmations, lineup-lock reminders, match-start alerts, results notifications, responsible-gaming notifications (such as deposit-limit warnings and account-security alerts), and marketing messages (new contest announcements, special-event promotions, and re-engagement offers).

Message Frequency

Recipients may receive 1–3 messages per week (capped at one message per day per user). Message frequency may vary based on the categories of messages a user has opted into and the user's activity on the platform.

Message and Data Rates

Message and data rates may apply, based on the recipient's mobile carrier plan. Runtiva does not charge for SMS messages; standard carrier message and data rates apply to the recipient.

Mobile Number Non-Sharing

Runtiva does not share, sell, rent, or lease mobile phone numbers collected for SMS communications with third parties for marketing or promotional purposes. Mobile phone numbers are shared only with our SMS service provider (Twilio Inc.) for the sole purpose of delivering the SMS messages users have consented to receive, and as otherwise required by law.

Opt-In

Users opt in to receive SMS communications during account registration in the Runtiva mobile app (iOS or Android) by checking a dedicated SMS-consent checkbox, separate from Terms of Service acceptance. Opt-in is also available at any time after registration via Account > Notification Preferences in the mobile app.

Opt-Out and Help

Users may opt out of SMS communications at any time by replying STOP to any message received from Runtiva. Confirmation of opt-out will be sent. Users may also change their SMS preferences in the mobile app preference center, and may re-subscribe by replying START. For help with SMS communications, reply HELP to any message or contact support at support@runtiva.com.

Compliance

Runtiva's SMS program is designed to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and the Cellular Telecommunications Industry Association (CTIA) Short Code Monitoring Handbook. Recipients who believe they are receiving SMS communications in error may contact Runtiva support immediately.

Advertising, Cookies, and Similar Technologies

We and our third-party partners use cookies, web beacons (also known as pixels or clear GIFs), local storage, device identifiers, and other similar tracking technologies (collectively, "Tracking Technologies") on our website, mobile apps, and other services (collectively, "Services") to enhance your experience, analyze usage, personalize content, and deliver targeted advertising. This section explains how we use these technologies, the types involved, their purposes, and your choices for managing them.

Types of Tracking Technologies We Use

Cookies: Small text files stored on your device that help us remember your preferences, login details, and interactions with our Services.

Global Privacy Controls (GPC): We honor browser signals like GPC where required by law, which automatically opts you out of sales/sharing for targeted ads.

Opt-outs are specific to your browser or device, so you may need to opt out on each one you use. Clearing cookies may reset your choices. We do not respond to general "Do Not Track" signals from browsers, as there is no industry standard for compliance.

What Information Can I Access?

You can access your information, including your name, address, payment options, profile information, and purchase history in the "Your Account" section of the website or app.

Minors

Our Services are not designed for minors, as defined under applicable laws for handling personal information. We do not intentionally gather or store personal data from minors through our platform.

Should we learn that a minor has provided personal information, we will immediately delete that data from our systems and terminate the associated account.

If you are a parent or guardian and suspect your child under 18 has shared personal information with us, please contact our Privacy Team at privacy@runtiva.com, and we will take steps to remove the child's data promptly.

Data Retention, Information Security, and Integrity

We are committed to handling your personal data responsibly, which includes retaining it only as long as necessary, implementing robust security measures to protect it, and ensuring its accuracy and integrity. This section explains our practices in these areas.

Data Retention

We retain your personal data for as long as it is reasonably necessary to fulfill the purposes for which it was collected, and in accordance with applicable law. The specific retention periods vary depending on the type of data and the context in which it is used. For example:

Account and profile information may be retained for the duration of your active use of our Services, plus a reasonable period thereafter to handle any post-account closure inquiries or disputes (typically up to 2 years after account deactivation).
Transactional and commercial data, such as contest entries, payment records, and prize histories, are kept for at least 7 years to comply with tax, accounting, and legal requirements.
Usage and analytics data may be retained in aggregated or anonymized form indefinitely to improve our Services, but identifiable data is deleted after 24 months unless needed for ongoing purposes.
